I have noticed on the poster for this event that a Miss Scarlet Fever will be performing I would like to clear up any confusion and state that its not THE Scarlet Fever of Faking it fame but a newbie using Scarlet's name. This issue is going to be rectified soon as its a blatant rip off or someone who clearly doesnt google before choosing a name.

The Scarlet Fever in this show was completely unaware of the Scarlet Fever that you are familiar with until people pointed it out to her!
She had thought of a new name, I don't know why this hasn't been used. She really doesn't mean any harm, she's not familiar with the burlesque scene as she only dances occasionally for fun. Therefore, she doesn't realise how much people can get annoyed about this.
Personally, I've been leaving her name off any publicity as I didn't want to mislead anyone into thinking that the 'real' Scarlet Fever was appearing.
I was concerned when I saw the poster & I will speak to the organiser about changing it.http://www.mydelilah.co.uk Burlesque & Pin-up Costumes & Accessories

Scarlet Fever
Thank you for your post, I am employed by Scarlet so I contacted Foo Foo Labelle on Sunday via Facebook with regards to the poster. Scarlet has also been contacted by past workshop students from the Cardiff area enquiring about the show and informing Scarlet how excited they are about getting the opportunity to see her perform! The young lady concerned is not solely to blame her only mistake was not to google before choosing a stage name. Scarlet is hardly difficult to find since she has appeared on Faking it, This morning show S4C's Sioe Gelf based in Cardiff. The promoters of the show have been friends of Scarlet's on Facebook for several months so I would have thought the subject would have arisen earlier. If the poster is removed from facebook and it made clear on flyers etc that this is the case the threat of legal action will be not be nessesary

Scarlet Fever is a splendidly ironic stage name for a burlesque performer, given that the condition commonly manifests its's self with a lurid rash on the chest and in the groin.
The question of who may or may not be allowed to legitimately associate his or herself with this disease would be answered more accurately by Spotlight or Equity than by Google.
Ultimately, a performer or promoter can choose and use any name they want to unless that name infringes a registered trade mark.
I'll never be able to join Equity under the name my parents gave me, but the former host of Countdown will never be able to get my name taken off a poster unless he has registered his own identity in relation to the provision of specific goods and services.
Equity recommend that one should choose a stage name that is unique in order to prevent confusion with another individual.
That said, one of my favourite authors is David Mitchell and I have some admiration for the comic actor who shares the same name.
I suppose the best solution for the two Scarlets would be for one of them to diverge from the genre of burlesque or for both of them to set their sights on becoming the best known and most talented person whose act and image is associated with that name.
But who am I to give advice?
Des O'Connor :-)

Des is quite right, of course

I suggest that before anyone wades in with unnecessary and unhelpful threats, it might be advisable to discuss this privately? Also, you each might wish to clarify your position (if the name is to stick) with regards to where you stand, with your rights. It's a common mistake to make, but using a stage name doesn't make it 'yours'. Copyright law is a little more involved than this.
I notice that no-one is considering the position of the American Scarlet Fever (who has been performing burlesque since 2005). See here for her site: About Me
